DATE: November 16, 2012
An incident occurred at Macon Middle School this morning and Sheriff Holland states: "At NO" time was any
student or any other person in any danger."
A student told another student that he/she had found what he/she believed to be a "pipe bomb" and this was subsequently reported to
school personnel. The Sheriff’s Office and other first responders were notified and initiated an investigation. The initial
information available did not indicate that any device was on school property; however in an abundance of caution a portion of
the campus was treated as a crime scene and thoroughly searched by Deputies and NO explosive device was discovered.
While the search was taking place, Investigators interviewed the student and were informed that the device was not on school
property but had been seen in an old barn near the student’s residence. Investigators located the device where the student
said he saw it and it was determined to be an old-fashioned automotive timing light and not in any way a dangerous or explosive device.
Sheriff Holland states: "School personnel, Emergency Management, first responders and my officers acted professionally and
appropriately in dealing with this incident and I want to thank everyone involved for their assistance."

Detectives with the Macon County Sheriff’s Office Investigations Unit have charged four Macon County residents with
numerous property crimes involving five residences in Macon County. All of the residences were unoccupied when the
crimes were committed and one of the crimes involved a stolen tractor that was recovered in Georgia. With information
from a previous investigation, Crime Stoppers tips and statements made by the defendants most of these crimes were
charged prior to being reported by the victims. Macon County detectives also contacted the Haywood County Sheriff's Office
and provided information regarding additional
crimes that occurred in Haywood County.
The defendants and current charges are as follows:
Joshua Cataldo Smith, age 19 of Franklin; charged with seven counts each of Felony Larceny and Possession of Stolen Goods,
five counts of Injury to Real Property, and six counts of Second Degree Burglary. He is in custody with a $31,000 bond.
Sandra Elaine McCormick, age 18 of Franklin; charged with four counts each of Felony Larceny and Possession of Stolen Goods,
and three counts of Second Degree Burglary. She is in Custody with an $18,000 bond.
Nathan Shane Humphries, age 19 of Franklin; charged with seven counts each of Felony Larceny and Possession of Stolen Goods,
one count of Possession of a Stolen Vehicle, and six counts of Second Degree Burglary. He is in custody under No Bond.
Morgan Corissa Cowart, age 17 of Franklin; charged with five counts each of Felony Larceny and Possession of Stolen Goods,
and four counts of Second Degree Burglary. She has been released on bond.
The investigation is ongoing and additional charges are possible. Anyone who has any information regarding these defendants
and crimes, or other crimes, is requested to contact the Sheriff’s Office or Crime Stoppers.
Sheriff Holland states:
"These suspects were going to homes that appeared to be owned by part-time residents of Macon County and making several
visits to the homes before breaking in. We believe there are other homes broken into that have not yet been discovered and
encourage residents to be good neighbors by checking on their neighbor’s homes and reporting anything suspicious to law enforcement."

Follow-up Information on Operation Medicine Drop
The Macon County Sheriff’s Office collected 159 pounds of medication or approximately 65,000 dosage units on
Saturday and will deliver them to the NC SBI’s Asheville office for environmentally safe disposal.

The Macon County Sheriff’s Office will participate in a fifth Operation Medicine Drop on Saturday, September 29, 2012.
This is part of a nationwide initiative that will coincide with "Wake Up To Medicine Abuse" week sponsored by PartnershipforDrugfree.org,
the Drug Enforcement Agency and Safe Kids of North Carolina. This is a drug take-back event where unused and expired
prescription and over-the-counter medications are collected from the public to be disposed of safely and properly.

The Macon County Sheriff’s Office participated in the US Marshals Service Operation Mountain Top on August 1st.
This was a multi-agency, multi-county initiative to verify that registered sex offenders were in compliance with all
Federal and North Carolina registration requirements. Participating agencies included: the US Marshals Service, Macon
County Sheriff’s Office, 30th District Attorney’s Office, FBI, NC SBI, NC Division of Community Corrections, and
the Sheriff’s Offices in Clay, Graham and Cherokee counties.
The purpose of this initiative was to enforce the provisions of SORNA, the Sex Offender Registration and Notification Act
which is Title I of the Adam Walsh Child Protection and Safety Act of 2006 (Public Law 109-248). SORNA provides a
comprehensive set of minimum standards for sex offender registration and notification in the United States.
SORNA aims
to close potential gaps and loopholes that existed under prior law and generally strengthens the nationwide network of
sex offender registration and notification programs. In addition to the initial registration requirements, North
Carolina law requires registered sex offenders to verify their information in the registry twice a year.
In Macon County five teams of officers conducted 49 random compliance checks on registered sex
offenders, made contact with 39 individuals and searched 30 residences. One felony arrest was made on August 1st
and additional violations are being investigated with additional felony charges expected. Eric D. Holland age 30, of
Addington Place, Franklin, NC was charged with Failing to Report New Address, a class F felony.
Sheriff Holland states: "Requiring a registered sex offender to follow North Carolina registration requirements
is not unfair. While some of the violations may seem minor, they are requirements that the sex offenders were informed
of when they initially registered. My Office will continue to have a zero tolerance policy for registration violations
by convicted sex offenders and those who fail to comply with the law will be held accountable."

This is part of a statewide initiative which includes the NC State Bureau of Investigation, the Franklin Police Department, the Highlands Police Department and Safe Kids of North Carolina. Macon County Sheriff’s Officers were dispatched to a residence in Highlands, NC, on February 2, 2012 at approximately 6:00 pm regarding two unattended deaths. The bodies of Kenneth Simmons, age 71, and Frances Harriet Simmons, age 71, were discovered in the residence by two family members who also resided in the residence. A pet dog was also deceased from apparent gunshot wounds. The family members reported the situation to Macon County 911.
The preliminary results of Mr. Simmons’ autopsy indicate that his cause of death of was from multiple gunshot wounds. The preliminary results of Mrs. Simmons’ autopsy indicate that her cause of death was from a single gunshot wound. A five page note believed to have been written by Mrs. Simmons was found in the residence.
The residence was secured and Investigators from the Sheriff’s Office were contacted to initiate an investigation. An Investigator was present at the autopsy on February 3rd and items of evidence were seized from the residence and during the autopsy. No criminal charges are expected to be filed and the Investigation will remain open pending the final autopsy report.
At the request of the family members who resided in the residence, the Sheriff’s Office is releasing this information so that the public will be made aware of the facts surrounding this unfortunate incident. Additionally, Mr. Simmons was extremely ill and under care of hospice when the incident occurred.

Agencies Seek Help in Finding Rape Suspect, Composite Sketch Released
ASHEVILLE, N.C. - The Macon County Sheriff’s Office, the U.S. Forest Service and the State Bureau of
Investigations (SBI) are seeking information on a rape which occurred Sunday September 25, 2011, at
approximately 4:00 p.m. in Macon County within the Nantahala National Forest.
The incident occurred at the intersection of Forest Service Road (FSR) 711 and the Wayah Road, FSR 1310. A
female driving through the area stopped to render aid to a person she believed was incapacitated who
was lying beside the road. At that time a firearm was used to subdue the victim and she was allegedly
forcibly raped.
Law enforcement authorities are seeking information and assistance in identifying a possible suspect.
Authorities are looking for a white male, 6’0", 200 pounds, between the ages of 30 and 40, having brown
wavy short hair, no facial hair, green to blue eyes, having a deep voice and a fair complexion. The
suspect was last seen wearing dark blue jeans and a medium blue shirt. The subject is armed and
considered dangerous and may be carrying a backpack. No vehicle information is available at this time.
The attached composite sketch was rendered to assist in identifying the assailant.
On the same date and approximate location, a motor grader was vandalized and diesel was stolen. Earlier
the same day, three individuals were observed around the motor grader that may have information relevant
to the case. These individuals or persons knowing these individuals’ identities are asked to call law enforcement.

On Friday August 5 deputies arrested a Franklin man on multiple charges related to Child Pornography. After
receiving information from a concerned citizen, John Kennedy of Shady Cove Lane age 47 was arrested by
MCSO deputies following the execution of two separate search warrants.
During an interview with the Mr. Kennedy he admitted to trading hundreds of photographs of children that
were pornographic in nature. Investigators have seized evidence during the execution of the search warrants
where numerous items were seized including computers.
Investigators are requesting your assistance in locating any potential victims or anyone that may have information
that could be useful in the prosecution of John Kennedy. Mr. Kennedy admits that he used the internet and
frequently used FaceBook as well as other means of social networking including AOL and YAHOO Chat rooms to
commit these offenses.
If anyone feels that they or their children may have received any inappropriate communications with Mr. Kennedy
we are encouraging you to contact the MCSO Juvenile Investigations Unit immediately.
Sheriff Holland states, "This case was initiated following a telephone call from a concerned citizen
who had a "Gut Feeling" that something was not right about Mr. Kennedy and his behavior."
While conducting their investigation and working with California and Texas Authorities, MCSO
investigators were able to gather enough information to allow them to successfully obtain and
execute search warrants at the suspect’s residence. The hard work of investigators led to Mr.
Kennedy’s subsequent arrest taking another predator out of our community.
Investigators with
the MCSO are currently analyzing the computers looking for additional evidence against Mr.
Kennedy and any other individuals who may have been involved. In closing Sheriff Holland states,
"We will be analyzing these computers and evidence searching for Any and All individuals who
were involved with trading pornographic material involving children with Mr. Kennedy. All
individuals will be aggressively sought, investigated, arrested and prosecuted."
John Kennedy is currently charged with 1 Felony Count of 3rd Degree Sexual Exploitation of Minor
and 1 Felony Count of Identity Theft with additional charges expected today. Magistrate Brandon
McDowell set a Secured Bond of $50,000.00 on his initial charges with his first court appearance
set for August 18, 2011 in Macon County District Court. John Kennedy remains in custody at this
time.

The Macon County Sheriff’s Office responded to an Emergency-911 call at approximately 6:10 pm on Monday
August 1st on Rose Creek Cove Road in the Cowee Community. A breaking and entering and sexual assault
were reported to have occurred at approximately 5:00 pm on that day. The reporting victim did not know
the suspect and his mode of transportation is also unknown.
An investigation started immediately and two Investigators were assigned to the case Monday night at which
time they began processing the crime scene and interviewing witnesses. This is an on-going investigation
and the Sheriff’s Office is requesting assistance from any person that observed any unusual or suspicious
activity or individuals in this area, specifically including Highway 28/Bryson City Rd., Bennett Rd., and
Rose Creek Rd., on Monday or at any other recent time.
The suspect is described as being a white male, approximately 6 feet tall with short dark brown hair, no
facial hair and blue or green eyes. He has a skinny to medium sized frame and a noticeable tan. He was
reported to be wearing blue jean shorts, a black t-shirt with pocket and flip flops at the time of the assault.
It is possible that he has scratch marks on his body.
Investigators canvassed the neighbors in the Rose Creek area and continue to pursue the information they gathered.
Deputies from the Patrol Unit set up road blocks to speak with drivers and residents in the area Tuesday and
Wednesday and have passed on additional information to the Investigators. Investigators are being assisted
by the Asheville Police Department and met today with the reporting victim and a forensic artist to prepare a
sketch of the suspect. See Below.
Sheriff Holland states: "Although this appears to be an isolated incident, I encourage all residents to take
normal security measures and to be aware of their surroundings to ensure their safety. I consider this incident
to be our top priority and have instructed all of the Deputies involved to treat this investigation as their
highest priority. This investigation will continues and I encourage anyone with any information to contact
my Office or Crime Stoppers. I would also like thank the Asheville Police Department and the District
Attorney’s Office for their assistance."

Investigators with the Macon County Sheriff’s Office and the NC State Bureau of Investigation arrested
Randy Boyd Fouts on May 24th and charged him with the First Degree Murder of Thomas Larry Ramsey.
Fouts was indicted by the Macon County Grand Jury on May 23rd and had his First Appearance in
Macon County Superior Court on May 24th. Fouts is being held on no bond pending the appointment
of counsel. Fouts is 44 years old and is a resident of Macon County.
This joint investigation began in August of last year and also involved the District Attorney’s Office.
Numerous items of evidence have been analyzed by the NC SBI lab and other items remain to be analyzed.
A preliminary report from the lab provided sufficient evidence to indict Fouts at this time
due to public safety concerns. This is an ongoing investigation and anyone with any information
regarding Fouts or the Ramsey homicide is asked to contact the Sheriff’s Office.
No additional information will be provided at this time; however the Emergency 911 tape and Search Warrant
from August 2010, were Ordered to be unsealed at Fouts’ First Appearance and those records are now
available through the custodians of those records.

On Thursday, law enforcement officers from several WNC agencies that participated in "Operation Ice Melt"
arrested numerous suspects on drug related charges. Agencies that participated in the three month
investigation were the Macon County Sheriff’s Office Narcotics Unit, the Jackson and Swain County Sheriff’s
Offices and the NC State Bureau of Investigation.
In addition, the D.E.A Asheville Office, 30th District Attorney’s Office, Haywood & Clay County Sheriff’s
Offices, NC Probation & Parole and the Cherokee Indian Police also provided assistance.
During the course of this investigation 18 individuals were targeted for assisting in the manufacturing of
methamphetamine. Charges include conspiracy to traffic methamphetamine and conspiracy to manufacture methamphetamine.
While each agency has jurisdictional boundaries, law enforcement officers understand that criminals have no
boundaries and that fighting drugs and the crime associated with them requires a collaborative effort among the
law enforcement community. This investigation was initiated following previous arrests and seizures of individuals
for operating clandestine methamphetamine labs throughout Western North Carolina.
Sheriff Robert Holland states, "Citizens need to understand that any individual who participates or assists any
other person in the making or purchasing of materials to produce methamphetamine or any other drug is subject
to being investigated, arrested, and prosecuted to the fullest extent of the law."

The Macon County Sheriff’s Office conducted three (3) separate motor vehicle checking stations on New
Year's Eve with assistance from the Franklin Police Department and the NC Highway Patrol.
These checking stations resulted in:

The Macon County Sheriff's Office also conducted its 2nd annual Operation Think Twice on New Year's Eve.
This program offered free rides home to individuals between the hours of 9pm-6am. During the night,
51 individuals called the Sheriff's Office and requested rides home by Macon County Deputies and made
a conscious decision not to drink and drive.
Sheriff Robert Holland states, "I consider this prevention program to have been a success. While our check
points produced two drunk drivers, officers on routine patrol arrested 2 other individuals for drunk driving.
All four of these individuals refused to consider the consequences of their actions and did not take advantage
of our program; instead of getting a ride home, they were arrested and got a ride to jail."

We want 2010/2011 to be the safest New Year possible for the residents of Macon County and so we
are offering free rides - no questions asked - to those in need of this service.
It is illegal and unsafe to drink over the limit and drive. If you or someone you know needs this

The free service will be offered from 9pm until 6am December 31 and is sponsored by
Gooder Graphics, Mulligan's, Teague Contracting and Nathan's Paint & Body.

Macon County Project Lifesaver encourages all organizations, businesses, and individuals to
recognize that November is National Alzheimer's Awareness Month. Alzheimer's disease is a growing and serious
responsibility and all are encouraged to educate themselves on Alzheimer's disease and discover ways you can
help bring awareness and support to our community. Experts estimate nearly 5 million Americans currently have
Alzheimer's disease, and nearly 1 in 8 individuals will develop Alzheimer's by age 72. Even more frightening,
experts estimate that nearly 60% of individuals with Alzheimer's disease will wander at some point during the
progression of the disease.
The Macon County Sheriff’s Office and Macon County Senior Services have partnered to provide Project Lifesaver
services and equipment to the public since 2007. Project Lifesaver is a search and rescue, rapid recovery
program that targets persons enrolled in the program that have the tendency to wander due to Alzheimer’s,
Autism, Dementia, Down-Syndrome and other age or developmentally related conditions or disorders.
Project Lifesaver uses electronic tracking devices attached to at-risk individuals or their clothing to
assist in locating them if they become lost.
Caregivers of at-risk individuals who are interested in the program may contact Karen Wisman at Macon County
Senior Services (349-2059) for an initial screening for the program. After the screening, applications may
be submitted to the Macon County Sheriff’s Office and Public Information Officer Jim Lau (349-2575) will make
arrangements to issue the equipment and review the program with the caregiver.
There is no cost to the individual or caregiver for this program. Macon County Project Lifesaver is partially
funded by Macon County but also depends on public and private donations for operating expenses. To make a

Sheriff Robert L. Holland and a total of fifteen officers from the Macon County Sheriff’s Office
have now completed Crisis Intervention Team (CIT) training. The second CIT class at Southwestern
Community College’s Jerry Sutton Public Safety Training Center in Macon County was held October 25th-29th.
Other participants included officers from the Franklin Police Department, NAMI and the Southwestern
Commission Area Agency on Aging.
The 40 hour class was sponsored by Smoky Mountain Center, Southwestern Community College, NAMI Appalachian
South and NAMI Haywood with grants from the Town of Franklin and the Macon County Community Foundation.
The presenters included clinicians from Smoky Mountain Center, Appalachian Community Services, The Western
Regional Alzheimer’s Association, NAMI, Bob Scott, Dr. Lisa Verges (psychiatrist in private practice), and
Janssen Pharmaceuticals.

The objectives of the training were to increase law enforcement’s knowledge about mental illness; to learn
about community resources; to learn how to connect mental health clients to the appropriate resources; and
to avoid incarceration and involuntary commitments when such action is appropriate.
Certificates from Southwestern Community College and Gold CIT Pins were presented to the law enforcement officers
by Dr. Jim Pitts, President NAMI Western Carolina, Board Member NAMI NC and Chairman Ronnie Beale, Macon County
Board of Commissioners.
Sheriff Holland states: "My own participation in this training confirmed my belief that the CIT concept is a
proactive asset that can be used by law enforcement officers and detention officers when they are interacting
with individuals who have mental health issues. I will continue to support CIT training and intend to send
all full-time Officers employed by the Sheriff’s Office to the training as additional classes become available.
I would also like to thank NAMI and Southwestern Community College for sponsoring this training."

David Wayne Ogden, age 63, of Derby Street, Franklin, NC was indicted by the Grand Jury during the
November 1st term of Criminal Superior Court on the following charges:
Four counts of First Degree Sexual Exploitation of a Minor;
Eight counts of Third Degree Sexual Exploitation of a Minor;
One count of Delivering a Controlled Substance to a Minor;

On Friday night and Saturday morning Macon County Sheriff’s Office Detectives executed a search warrant
and arrested David Wayne Ogden, age 63, of Franklin. Ogden is currently charged with: two counts of First
Degree Sexual Exploitation of a Minor; two counts of Third Degree Sexual Exploitation of a Minor; one
Count of Delivering a Controlled Substance to a Minor; and one Count of Possession of a Firearm by a Felon.
Bond has been set at $120,000 and Ogden is scheduled to appear in Macon County District Court on November 4th.
This is an ongoing investigation and Detectives are following up on information and evidence obtained during
the execution of the search warrant on Ogden’s Derby Street residence in Franklin. Detectives are aware that
Ogden has multiple accounts with social networking websites and suspect that he initiated inappropriate
communication and information exchanges with local minors as well as children in other counties and states.
Ogden may have also contacted children by cellular telephone, e-mail or in person.
Sheriff Holland states, "I encouraging parents to talk with their children about Mr. Ogden and to contact the
Sheriff’s Office if their children confirm any contact or communication with Ogden.

had contact with minors in this capacity as well. I want to assure the public that Detectives will conduct
a thorough investigation and will follow up on any and all reports provided by citizens."

Eight Officers from the Macon County Sheriff’s Office have now completed Crisis Intervention Team
(CIT) training sponsored by Smoky Mountain Center and NAMI. Two Officers previously attended a training
session in Boone, NC, which is part of Smoky Mountain’s northern region. Six additional Officers completed
CIT training last month at Southwestern Community College in Macon County and eight to ten officers will
take the class next month.
The August class in Macon County was the first training session offered in Smoky Mountain’s southern region,
which consists of the seven westernmost counties in the State. A committee with representatives from Smoky
Mountain Center, NAMI, the Waynesville Police Department and Southwestern Community College began planning
the training several months prior. A Sheriff’s Office employee is now participating in the planning and
a second training session is scheduled at Southwestern Community College in Macon County the week of October 25th.
The objectives of CIT training are: to increase knowledge and understanding of mental health issues; learn to
recognize symptoms of common psychiatric disorders; learn about community resources and develop an understanding
of them; and to divert mentally ill individuals to community resources when such action is appropriate.
Sheriff Holland states: "I fully supported the CIT concept after being briefed on the benefits and that is
why I designated two employees to attend a training session outside of our region last March. Because the
class size is limited, I was only able to send six employees to the first class in Macon County, but I
intend to send all full-time employees of the Macon County Sheriff’s Office to CIT training as classes
become available."
"Student comments and evaluations of the training confirmed my belief that the CIT concept is a proactive
asset that can be used by Law Enforcement Officers and Detention Officers when they are interacting with

On Wednesday, July 29, at approximately 4:43 a.m., Macon County Sheriff's Office Deputies
were dispatched to a residence on Mountain Grove Road, Franklin, N.C. After the residence
was secured, Macon County Emergency Medical Services personnel responded and determined
that Keith Williams, age 49 of Franklin, was deceased.
The Sheriff's Office conducted a homicide investigation regarding the facts and circumstances
that resulted in the death of Keith Williams. This was a joint investigation with the N.C. State
Bureau of Investigation and the District Attorney's Office. The results of the investigation
were dependent upon numerous interviews, the collection of evidence and records, tests conducted
on evidence and the autopsy report.
A copy of the Sheriff’s Office file with the results of the investigation has been provided to the
District Attorney’s Office and any decision regarding Grand Jury proceedings will be made by the
District Attorney. Requests for additional information regarding this decision should be directed
to District Attorney Mike Bonfoey.
This is an open investigation and if any additional information becomes available in the future it
will be reviewed by investigators. There is no additional information available from the
Sheriff’s Office at this time.

Officers with the Macon County Sheriff’s Office and the Highlands Police Department arrested
Mitchell Lee Stahl on September 14th. Stahl, age 34, of Dendy Orchard Road, Highlands, NC is
in custody with a $250,000 secured bond and was charged with nine felonies as follows:
Two counts of Sell or Deliver a Schedule II controlled substance;
Two counts of Maintaining a Place for Keeping or Selling a controlled substance;
Two counts of Possession With Intent to Sell or Deliver a controlled substance;
Two counts of Trafficking in Opium;
One count of Sell or Deliver a Schedule IV a controlled substance.
This joint investigation began after the Sheriff’s Office Narcotics Unit received a tip from a
citizen and targeted a drug dealer who was selling prescription drugs, primarily in the Highlands
area. The investigation was extensive and time consuming but the result justified the investment
of resources by both agencies.
The investigation’s focus on criminal violations of prescription drugs laws parallels Operation
Pill Crusher in 2009 and Operation Medicine Drop in 2010, in which the Sheriff’s Office, the Highlands
Police Department and the Franklin Department participated. Both of those operations were
non-criminal initiatives that collected over a hundred thousand dosage units of outdated and unused
prescription pills from Macon County citizens.
The goals of those initiatives were to: reduce the theft of prescription drugs; reduce the illegal
transfer of drugs; ensure that unused pills are properly disposed of; and limit children’s access to
prescription drugs.
According to the Centers for Disease Control opioid painkillers are involved in more overdose deaths
than heroin and cocaine combined and rural America is particularly at risk, with states in the
Appalachian region having the highest death rates. That is the reason that enforcement of prescription
drug violations has been a Sheriff’s Office priority for over two years.

Investigators with the Macon County Sheriff’s Office arrested Tracy Eugene Hooper for breaking into
three Macon County businesses. Hooper, age 33 of Franklin, was a part-time Jailer and Deputy Sheriff
with the Macon County Sheriff’s Office from 1998 to 2001 and also worked as a law enforcement officer
in Jackson County.
Hooper was charged with:
- three counts of Felony Breaking and Entering
- three counts of Misdemeanor Injury to Real Property
- and one count of Misdemeanor Assault.
Hooper is currently in custody with an $8,000 secured bond.
The first crime occurred at HEALTHWORKS-REHABILITATION CENTER and was reported on August 3, 2010;
the second was at 441 FAMILY DINER on August 7, 2010; and the third was at STANDING INDIAN STORE today,
August 9, 2010. An employee of the store opened the business at 7:55 am this morning while Hooper was
inside the store and he knocked the employee out of his way as he fled the building.
The employee called Emergency-911 immediately and provided a detailed description of Hooper and the
vehicle he used to flee the scene, a black 2007 Chevrolet Silverado. A Patrol Deputy located the
vehicle and stopped it on Highway 64 West. The case was then turned over to Investigators who
gathered evidence and connected Hooper to the two earlier crimes.
Sheriff Holland states: "As our nation deals with the current economic crisis, local law enforcement
is dealing with an increase in property crimes and I encourage the public to report any suspicious
activity to law enforcement as soon as possible. As your Sheriff I have emphasized a proactive
approach to law enforcement that includes building partnerships within our communities.
I implemented programs such as Crime Stoppers and Community Watch to be assets for law enforcement, but
they require participation by the public to be effective tools in solving crimes. This is an ongoing

The Macon County Sheriff’s Office previously charged three individuals for Felon Breaking and Entering, Larceny and Possession of stolen Goods during the week of July 21, 2010. The three individuals are: David William Heller, age 20, of Franklin; Harley Thomas Golden, age 24, of Franklin; and Paul Joseph Quinn, age 21, of Franklin
These charges resulted in an ongoing joint investigation with the Franklin Police Department and District Attorney’s Office involving a series of property crimes that were reported by
the following businesses:
- Big D Gas Station and Convenience Store
- Pizza Hut
- J. H. Duncan Oil Company
- Mountainside Chocolates
- Sassy Shears Salon
- Nathan’s Paint and Body Shop
- Macon County Farm Bureau
- Duvall of Franklin
- Sellers Real Estate
- Doobie’s Alternative Gifts (2 separate incidents)
- and Main Street Pizzeria.
The three individuals are still in custody and are currently charged with the following;
- Heller has a $40,000 secured bond and is charged with two counts each of Felon Breaking and Entering, Larceny and Possession of stolen Goods;
- Golden has a $182,000 secured bond and is charged with nine counts each of Felon Breaking and Entering, Larceny and Possession of stolen Goods, one count of being a Habitual Felon, two counts of Probation Violation, one count of Attempted Breaking and Entering, Assault on a Government Officer and Resisting a Public Officer;
- Quinn has a $105,000 secured bond and is charged with ten counts each of Felon Breaking and Entering, Larceny and Possession of stolen Goods, and one count of Attempted Breaking and Entering.
Investigators seized evidence and conducted interviews that indicated all three defendants have been engaged in gang-related activities and were attempting to organize a gang they referred to as “NGO?? or “New Generation Outlaws??.
This is an ongoing investigation that may result in additional charges and additional suspects. On Wednesday, July 29, at approximately 4:43 a.m., Macon County Sheriff's Office Deputies were
dispatched to a residence on Mountain Grove Road, Franklin, N.C. As stated in an application
for a Search Warrant that will be available at the Clerk of Court's Office as a public record;
Macon County Emergency-911 received a telephone call from an individual who advised that he had
shot his father, Keith Williams, at their residence.
After the residence was secured, Macon County Emergency Medical Services personnel responded and
determined that Keith Williams, age 48 of Franklin, was deceased.
The Sheriff's Office is conducting an ongoing homicide investigation regarding the facts and
circumstances that resulted in the death of Keith Williams. This is a joint investigation with
the N.C. State Bureau of Investigation and the District Attorney's Office. The son and another
individual were detained for investigative purposes while the scene was secured and evidence was
collected.
Both of the individuals were interviewed on Wednesday, evidence was seized and processed for testing,
and an autopsy is scheduled for today. The conclusion of this investigation is dependent on the
results of the forensic tests and the autopsy; therefore investigators with the Sheriff’s Office,
the SBI and the DA’s Office determined that there was insufficient evidence to proceed with criminal
charges at this time. As a result, both the son and the other individual were released from
investigative custody, as required by law, on Wednesday.
Again, this is an ongoing investigation that will require additional interviews, collection of
records, testing of evidence and the autopsy report. There is no additional information available at
the present time.

The Macon County Sheriff’s Office and the North Carolina Sheriff’s Association hosted a U.S. Immigration
and Customs Enforcement (ICE) Secure Communities Training at Southwestern Community College’s Public Safety
Training Center on Tuesday, July 13th (see attached ICE press release for additional information). Nine
employees from the Macon County Sheriff’s Office attended the training along with employees from seven other
Sheriff’s Offices.
Sheriff Holland states: "I fully support the Secure Communities initiative and believe it is a proactive law
enforcement tool that helps identify criminal aliens who have been charged with crimes. As required by
State law, the Detention Center makes an inquiry of ALL inmates in an attempt to determine whether they
are legal residents of the United States and this enhanced information sharing will assist Detention
Officers in complying with this requirement.
This initiative does NOT involve any type of public or
workplace "roundups"; instead it targets individuals who have been charged with a crime and have prio
criminal convictions and/or immigration violations. Criminal aliens that are identified as a result of
this initiative have self-reported themselves to ICE and local law enforcement and should suffer the
consequences of their actions.

facility and the NC Sheriff’s Association and ICE for providing this training."

ICE launches Secure Communities strategy in eight additional North Carolina counties
Uses biometrics to prioritize immigration enforcement actions against convicted criminal aliens
CHARLOTTE, N.C.- On Tuesday, U.S. Immigration and Customs Enforcement (ICE) began using a new biometric
information sharing capability in eight additional North Carolina counties that helps federal immigration
officials identify aliens, both lawfully and unlawfully present in the United States, who are booked into
local law enforcement’s custody for a crime. This capability is part of Secure Communities - ICE’s comprehensive
strategy to improve and modernize the identification and removal of criminal aliens from the United States.
Previously, fingerprint-based biometric records were taken of individuals charged with a crime and booked
into custody and checked for criminal history information against the Department of Justice’s (DOJ)
Integrated Automated Fingerprint Identification System (IAFIS). Now, through enhanced information sharing
between DOJ and the Department of Homeland Security (DHS), fingerprint information submitted through the
state to the FBI will be automatically checked against both the FBI criminal history records in IAFIS and
the biometrics-based immigration records in DHS’s Automated Biometric Identification System (IDENT).
"The Secure Communities strategy provides ICE with an effective tool to identify criminal aliens in local
custody," said Secure Communities Executive Director David Venturella. "Enhancing public safety is at
the core of ICE’s mission. Our goal is to use biometric information sharing to remove criminal aliens,
preventing them from being released back into the community, with little or no additional burden on our
law enforcement partners."
Today’s announcement includes the following eight counties: Cherokee, Clay, Graham, Haywood, Macon, Madison,
Swain and Yancey. With the expansion of the biometric information sharing capability to these counties,
ICE is now using it in 29 North Carolina jurisdictions. Across the country, ICE is using this capability in
448 jurisdictions in 25 states. ICE expects to make it available in jurisdictions nationwide by 2013.
If any fingerprints match those of someone in the DHS biometric system, the new automated process notifies ICE.
ICE evaluates each case to determine the individual's immigration status and takes appropriate enforcement action.
This includes aliens who are in lawful status and those who are present without lawful authority. Once identified
through fingerprint matching, ICE will respond with a priority placed on aliens convicted of the most serious
offenses first - such as those with convictions for major drug offenses, murder, rape and kidnapping.
Since ICE began using this enhanced information sharing capability in October 2008, immigration officers have
removed from the United States more than 8,500 criminal aliens convicted of Level 1 crimes, such as murder, rape
and kidnapping. Additionally, ICE has removed more than 22,200 criminal aliens convicted of Level 2 and 3 crimes,
including burglary and serious property crimes, which account for the majority of crimes committed by aliens.
Already in Florida, ICE has removed more than 1,800 convicted criminal aliens. ICE does not regard aliens
charged with, but not yet convicted of crimes, as "criminal aliens." Instead, a "criminal alien" is an alien
convicted of a crime. In accordance with the Immigration and Nationality Act, ICE continues to take action on
aliens subject to removal as resources permit.
The IDENT system is maintained by DHS’s US-VISIT program and IAFIS is maintained by the FBI’s Criminal
Justice Information Services (CJIS).
"US VISIT is proud to support ICE, helping provide decision makers with comprehensive, reliable
information when and where they need it," said US-VISIT Director Robert Mocny. "By enhancing the interoperability
of DHS’s and the FBI’s biometric systems, we are able to give federal, state and local decision makers
information that helps them better protect our communities and our nation."
"Under this plan, ICE will be utilizing FBI system enhancements that allow improved information sharing at
the state and local law enforcement level based on positive identification of incarcerated criminal aliens,"
said Daniel D. Roberts, assistant director of the FBI’s CJIS Division. "Additionally, ICE and the FBI are working
together to take advantage of the strong relationships already forged between the FBI and state and local law
enforcement necessary to assist ICE in achieving its goals."

The Macon County Sheriff’s Office and the N.C. State Bureau of Investigation arrested six individuals as part of a joint investigation targeting prescription pills and other controlled substances. The Clay County Sheriff’s Office and the District Attorney’s Office assisted in this investigation which began in 2009 at the conclusion of last year’s Drug Round-Up. Both investigations also included a non-criminal component that collected thousands of outdated and unused prescription pills from the public.
As a result of multiple complaints from citizens and several overdose deaths a particular residence was determined to be a priority by Sheriff Holland. A search warrant was executed on this residence, located at 15 Trimont Lake Road in Macon County, on June 4th utilizing the Sheriff’s Office Special Response Team. The U.S. DEA also assisted in the execution of search and arrest warrants at this residence.
At the request of the Macon County Sheriff’s Office, the U.S. Attorney’s Office initiated a civil forfeiture proceeding in U.S. District Court involving 15 Trimont Lake Road in Macon County and the U.S. Marshals Service served the property owner, Dorothy J. “This investigation confirmed my belief that we cannot allow a lack of funding to slow down our efforts in fighting drugs and other crimes associated with drugs. The Citizens of Macon County demand results and we are making every effort to provide results through proactive law enforcement initiatives. This investigation and subsequent arrests are the direct result of the hard work and dedication by the men and women of the Sheriff’s Office Narcotics Unit, the Macon County Sheriff’s Office and the other law enforcement agencies that assisted.
Unfortunately the current budget crisis resulted in the Governor’s Office eliminating a grant for the Sheriff’s Office Narcotics Unit after five years of funding. This could have resulted in the loss of a detective position and other assets necessary to conduct these types of investigations. As I informed the Board of Commissioners on Tuesday night, I believe that illegal drugs remains the major cause of crime in Macon County and that I would not allow the existing Narcotics Unit to be eliminated or reduced. The only option available would have been to decrease other services and reassign personnel to maintain the current Narcotics Unit; however, it appears that a majority of the Board agree with my view and that the current funding level will be maintained by the County.
This investigation also provided multiple leads in other cases in Macon County, other NC counties and other states; and resulted in the seizure of other contraband including a fully automatic rifle. This is an ongoing investigation and my officers are looking for other suspects and witnesses.
